1.About these terms
These Terms of Use (the “Terms”) govern your use of GamerGuides.com and the guides, community features and services we provide through it (the “Site”). The Site is operated by Gamer Guides Ltd (“Gamer Guides”, “we”, “us” or “our”), whose company details are set out above.
By accessing or using the Site, creating an account, or buying a subscription, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Site.
We have written these Terms in plain English. If anything is unclear, contact us at [email protected] before you rely on it.
2.Who can use the Site and accounts
You must be at least 13 years old to use the Site or create an account. If you are under 18, you should have your parent or guardian's permission.
You do not need an account to read most of the Site, but some features (such as commenting, reviews, bookmarks, the forums and Premium) require one. When you create an account:
- give accurate information and keep it up to date;
- keep your password secure and do not share your account with anyone else;
- you are responsible for activity that happens under your account;
- tell us promptly at [email protected] if you think your account has been used without your permission.
You can close your account at any time from your account settings.
3.Acceptable use
You agree to use the Site lawfully and responsibly. In particular, you must not:
- break any applicable law or regulation, or encourage anyone else to;
- post or share anything that is unlawful, defamatory, harassing, threatening, hateful, obscene, or that infringes anyone's rights;
- impersonate any person or misrepresent your connection with anyone;
- send spam, chain messages or unsolicited advertising, or collect other users' data;
- upload or transmit any virus, malware or other harmful code;
- attempt to gain unauthorised access to the Site, to other users' accounts, or to our systems;
- scrape, crawl, harvest or systematically copy the Site or its content, or use it to build or train any dataset, product or service, except as expressly allowed by these Terms;
- interfere with or disrupt the Site, or place an unreasonable load on it or its infrastructure.
We may remove content and restrict or end access if we reasonably believe this section has been breached.
4.Content you submit
The Site lets you submit content such as comments, reviews and star ratings, forum posts, and community contributions to our interactive maps and databases (for example map markers, locations, tips and notes) (“Your Content”).
You keep ownership of Your Content, but by submitting it you grant us a perpetual, irrevocable, worldwide, royalty-free, transferable and sub-licensable licence to use, host, store, reproduce, modify, adapt, combine, publish, translate, distribute, publicly display and otherwise exploit Your Content, in any media now known or developed in the future, for any purpose connected with our business, including operating, promoting and commercialising the Site. For example, if you submit a map marker or location, we may add it to our interactive maps and use it as part of the Site (including in paid or ad-supported features) without needing further permission or making any payment to you. This licence continues even after you close your account or Your Content is removed from public view.
You are responsible for Your Content, and you confirm that you own it or have the right to submit it, that it does not break these Terms or any law or infringe anyone's rights, and that it is accurate where it states facts. To the extent permitted by law, you waive any moral rights you may have in Your Content.
Content submitted by users is their own and does not represent our views. We do not review everything in advance, but we may moderate, edit or remove content, and we will act on valid reports and legal requests.
5.Our intellectual property
Except for Your Content and third-party material, everything on the Site, including the text, guides, walkthroughs, databases, interactive maps, articles, software, design, layout, look and feel, logos and graphics, is owned by or licensed to Gamer Guides Ltd and is protected by copyright, database rights, trade marks and other intellectual property laws.
We grant you a limited, personal, non-transferable and non-exclusive licence to access and view the Site for your own private, non-commercial use. You must not, without our prior written permission:
- copy, reproduce, republish, distribute, sell, rent or otherwise exploit any part of the Site or its content;
- systematically download, scrape or harvest the content, or use it to build or train any dataset, model, product or service;
- remove or alter any copyright, trade mark or other proprietary notice.
“Gamer Guides” and our logo are trade marks of Gamer Guides Ltd, protected by trade mark filings and registrations with the United States Patent and Trademark Office (USPTO), including the marks under USPTO serial numbers 88948524, 97685125 and 99766071. We take our brand and intellectual property seriously and will enforce our rights where necessary. Other trade marks, game names, artwork and materials shown on the Site are the property of their respective owners and are used for identification and editorial purposes only; their appearance does not imply any endorsement or affiliation.
If you believe content on the Site infringes your rights, contact us at [email protected] and we will respond promptly.
6.Premium subscriptions and payments
Some features are available through a paid subscription (“Premium”).
- The price, billing period and what is included are shown at the point of purchase, before you commit to buy.
- Payments are handled by our payment provider, Stripe. We do not see or store your full card details.
- Unless stated otherwise, subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time from your account settings; cancellation takes effect at the end of the current period, and you keep access until then.
Lifetime plans
Some subscriptions are offered as a “lifetime” plan. To be clear about what this means: a lifetime subscription lasts for the operational lifetime of the Site, not the lifetime of the subscriber. It gives you access to Premium for as long as we keep the Site running in a form that supports it.
We have every intention of keeping Gamer Guides online for the long term, and we work hard to do so. That said, no online service can promise to run forever. If the Site were to close, or if ownership of the business were to change hands in the future, we cannot guarantee that a new owner would continue any particular plan or apply these Terms in the same way. By buying a lifetime plan you understand and accept this.
If you have bought a lifetime plan and have started using the Site, you accept that you are not entitled to a refund simply because the Site later closes or its ownership changes, as you will already have received the access you paid for. This does not affect your right to a refund where one is genuinely due, for example if the service was not as described or of satisfactory quality, or for another legitimate reason recognised by law.
Refunds and statutory cancellation rights
Our Refund & Cancellation Policy explains the additional goodwill refunds we may offer, including our 7-Day Goodwill Refund Policy. These are provided in addition to, and do not limit, any mandatory rights you have under applicable consumer law.
If you are a consumer in the United Kingdom or European Union, you may have a statutory right to cancel certain purchases made online within 14 days. Different rules apply depending on whether the purchase involves services, digital content, or a combination of both.
Where you ask us to begin providing a service during the statutory cancellation period, we may begin providing that service immediately. If you subsequently exercise a statutory right to cancel, applicable law may allow us to charge a proportionate amount for the service already provided.
Where digital content is supplied immediately, such as downloadable content, you may be asked to expressly consent to supply beginning immediately and to acknowledge that, where applicable, you will lose your statutory right to cancel that digital-content supply once performance begins.
These provisions do not affect your statutory rights where content or services are faulty, not as described, not provided with reasonable care and skill, or where another remedy is required by applicable law.
You can cancel an automatically renewing subscription at any time from your account settings. Unless a refund or statutory cancellation right applies, cancellation takes effect at the end of the billing period you have already paid for and you will retain access until then.
Nothing in these Terms affects your statutory rights, including your rights under the Consumer Rights Act 2015 that digital content and services be as described, fit for purpose and of satisfactory quality. If a payment fails or is reversed, we may suspend Premium access until it is resolved.
7.Advertising and affiliate links
Advertising and affiliate arrangements help us keep most of the Site free to use.
Some links on the Site are affiliate links, which means we may earn a commission if you buy through them, at no extra cost to you. As an Amazon Associate we earn from qualifying purchases.
Advertising is managed through our advertising partner. How advertising cookies work, and the choices you have, are explained in our Cookie Policy.
8.Third-party links and services
The Site contains links to third-party websites and relies on third-party services (for example payment processing, analytics and advertising). We provide links for convenience and do not control or endorse third-party sites, and we are not responsible for their content, products or practices. Your use of any third-party site or service is subject to that third party's own terms and privacy policy.
9.Accuracy, security and availability
We care about getting things right. We work hard to run stable, secure systems, to protect the data you trust us with, and to keep our guides accurate. Our content is carefully checked by our team, and you can read how we look after your personal data in our Privacy Policy.
At the same time, games are updated constantly, and it is not always possible to reflect every change the moment it happens. When a game updates, we need a reasonable amount of time to work through and update our content so that it is as accurate as we can make it. Please bear this in mind, especially just after a game has changed.
For these reasons, the Site and its content are provided for general information and are made available on an “as is” and “as available” basis. We do not warrant that the content is always complete, accurate or current, or that the Site will be uninterrupted, secure or error-free. You are responsible for deciding whether the Site is suitable for your needs, and any reliance you place on its content is at your own risk. We may change, suspend or withdraw all or part of the Site at any time.
10.Our responsibility to you
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for anything else that cannot be excluded or limited under the law. If you are a consumer, your statutory rights are not affected by these Terms.
Subject to the paragraph above:
- we are not liable for any loss or damage that was not reasonably foreseeable, or that arises from your use of, or inability to use, the Site, or from your reliance on any of its content;
- we are not liable for indirect or consequential loss, or for loss of profits, revenue, data or goodwill, or for the acts or content of other users or third parties;
- where we provide paid services to you, our total liability to you for any claim connected with those services is limited to the amount you paid us for them in the 12 months before the claim.
If you use the Site as a business rather than as a consumer, you do so at your own risk, and we exclude all implied warranties and conditions to the fullest extent permitted by law.
11.Suspension and termination
You can stop using the Site or close your account at any time.
We may suspend, restrict or end your access to the Site or to particular features, or remove content, if you breach these Terms, our policies or the law, if your conduct harms (or is likely to harm) the Site, us or other users, or if we are required to by law.
Where it is reasonable to do so we will give you notice, but we may act immediately in serious cases. If your account is terminated for a serious breach, we may decline to provide the Site to you again. The sections that by their nature should continue after termination (including intellectual property, our responsibility to you, and governing law) will remain in force.
12.Privacy and cookies
We take your privacy seriously. Our Privacy Policy explains what personal information we collect and how we use it, and our Cookie Policy explains how we use cookies and similar technologies, in line with the UK GDPR, the Data Protection Act 2018 and, where it applies, the EU GDPR.
13.Changes to these terms
We may update these Terms from time to time, for example to reflect changes to the Site, our services or the law. When we do, we will change the “Last updated” date above and, where the changes are significant, we will take reasonable steps to let you know. By continuing to use the Site after the changes take effect, you accept the updated Terms.
14.Governing law and disputes
These Terms, and any dispute arising out of or in connection with them or your use of the Site, are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction.
If you are a consumer living in another part of the United Kingdom, or in the EU, you keep the benefit of any mandatory consumer protections of the country where you live, and you may be able to bring proceedings in your local courts.
15.How to contact us
